1- Scope of the Policy

3- Purposes, categories of data processed, legal basis for treatment and shelf-life
VIAEXPRESSO treats personal data of users of concessioned roads and other owners, in order to carry out its obligations as a concessionaire for the management, operation and conservation of the express roads concessioned under the SCUT regime, for purposes of accident detection and prevention, road assistance, protection and safety of persons and goods with regard to road traffic, maintenance of concessioned roads, handling of complaints and information to users, and control and monitoring of road traffic.
The VIAEXPRESSO in the pursuit of its activity treats the strictly necessary personal data, namely identification and contact data of users and other holders, driving license data, vehicle data (registration, characteristics) and documentation regarding the vehicle; accident or incident description data (including images of damages) and the circumstances in which they were caused (including date, time, location); data for billing and collection of road assistance services, content complaints, suggestions or requests for information, answers and clarifications and dates and times of their provision (management process).
Personal data are only kept for the period of time strictly necessary to allow the pursuit of the concession activity, compliance with the legal and regulatory obligations to which VIAEXPRESSO is attached and the exercise of their rights.
4- VIAEXPRESSO's Commitments to the Protection of Personal Data
As an integral part of its privacy policy, VIAEXPRESSO is committed to treating the data legally and reliably, collecting only the data necessary and relevant to the purposes for which it is intended; allow holders to access and correct their data; not use the data collected to be incompatible with the purpose for which it was collected and is the subject of information; keep accurate and, where applicable, current data; guarantee the exercise of the rights to erasure, opposition, limitation of treatment and portability in accordance with the conditions that result from the law for the exercise of these rights by the holder; have systems installed to prevent undue access, alteration or destruction to the data processed; respect of confidentiality principles for the protection of the data processed.
5- Categories of data recipients
The data collected will be exclusively used by VIAEXPRESSO for the indicated purposes and the treatment based on the fulfillment of its obligations as concessionaire of the Regional Expressways integrated in the concession. To this extent, information may be communicated to the Granting Authority (Madeira Autonomous Region) or to authorities or entities empowered to intervene in the areas in which the complaints or suggestions received are submitted, in compliance with legal duties or reporting obligations resulting from in the terms of the road concession, as well as to competent authorities, under the law, such as security forces or judicial authorities.
The VIAEXPRESSO, within the scope of the concessioned activity, may contract services which may imply the need for entities contracted to provide these services (Subcontractors), have access to personal data proceeding to its Treatment on account and according to VIAEXPRESSO instructions. VIAEXPRESSO only applies to Subcontractors which ensure the implementation of adequate technical and organizational measures for the protection of personal data, ensuring the protection of the rights of users and other owners in the light of the applicable legislation, which are bound to limit the processing of data on behalf of on account of VIAEXPRESSO with the same guarantees indicated in the above commitments and exclusively for the purposes indicated.
6. Exercise of the rights of users and other owners with regard to data concerning them
Users and other owners may ask VIAEXPRESSO to access personal data concerning themselves and to be processed by the same, as well as request the correction or update of the data that are outdated, incomplete or inaccurate. In the cases specifically provided for by law, the holders of the data also have the right to request the erasure of personal data that they respect, as well as the right of portability, limitation and opposition to the treatment of same, and the exercise of rights must be requested by written request addressed to VIAEXPRESSO to the email address This email address is being protected from spambots.
